Biography

David Cole is a partner in the Labor & Employment Law section of Freeman Mathis & Gary and is the practice group leader of the firm’s Data Security, Privacy, and Cyber Liability practice group.

In his employment law practice, David represents businesses and local governments in all aspects of employment law and litigation, including discrimination claims, wage and hour claims, family and medical leave claims, restrictive covenants, and trade secret litigation. David also advices employers on personnel policies and practices and helps them implement documents like employee handbooks, employment contracts, arbitration agreements, and severance agreements.

In his cyber practice, David advices and represents businesses and local governments in a variety of matters relating to data security and privacy laws.  He has extensive experience serving as breach counsel to help organizations respond to data breaches and comply with notification laws.  He also represents orgnizations in litigation related to data security and privacy, including lawsuits under federal laws such as the Computer Fraud and Abuse Act, as well in investigations into privacy practices by agencies like the Federal Trade Commission.

David has been selected three times as a Georgia Super Lawyers "Rising Star" as published by Atlanta Magazine, and in 2014 was selected as one of the "Top 20 Rising Stars Under 40" by Cobb Life Magazine and the Cobb Business Journal. He also is a frequent author and speaker on employment law and cyber liability issues.


David received his undergraduate degree in Business Administration from the University of Washington, magna cum laude, with a concentration in Computer Information Systems. He then received his Juris Doctor degree from Wake Forest University School of Law, where he was a member of the National Moot Court team and Student Trial Bar, and was selected to the National Order of Barristers.
