SESSION 1 - Anatomy of a Data Breach: Why Are We Here?

This session will explore the beginning, middle and end of a cyber-occurrence (data breach) from the perspectives of the various players involved.  We will discuss the nature of cyber risk and hear how policyholders plan, prevent, protect and detect unauthorized access to data.  We will explore what happens when there is a data breach and the ways companies can forensically track and investigate the breadth and scope of a breach.  We will learn what insurers look for and examine when they set out to underwrite this risk.  Finally, we will explore the legal issues that arise in the face of a data breach and how cyber claims are generally handled.   In the end, this session will provide a perfect foundation for learning more about various cyber risk.

SESSION 2 - Data, Data, Data & More Data.. How Much, How Long & Who is Legally Responsible for it?

Are your Insureds Lawyers, Health Care Providers, Financial Institutions, Government Entities, Wholesale or Retail business or something else that may be required to access, use, store and maintain data?  Are your Insureds domestic and internationally based?  This presentation will outline data retention laws, rules, regulations and proposed bills both domestically and internationally.  We will address procedures to store, access data, use, delete and destroy data.  We will also discuss what “reasonable” means in this context with the aim to assist you in spotting issues for Insureds at the point of sale, underwriting and claims handling level.  Careers in compliance are one of the fastest growing areas at present for good reason.  We hope you will leave with a new comfort level on what to look for in assessing these risks.

SESSION 3 - Case Study - Retail Breaches and the Payment Card Industry

Payment card breaches happen every day, but they are not like any other breach because of the PCI DSS rules in place.  This panel is comprised of experienced professionals who navigate these issues daily.  The panel will describe in laymans terms:  How companies learn that they have been breached and the ways that these breaches occur The relationships involved in a payment card breach and how those parties interact during the process The liabilities associated with a payment card breach and how exposure is calculated How law enforcement can assist in an investigation

SESSION 4 - Don't Make Your First Step in Breach Response a Stumble

Companies make the same mistakes when responding to breaches.  Just as you wouldn't ask a podiatrist to perform cardiac surgery, your breach response team needs to be experienced with helping you through this type of crisis.  The panel will discuss common mistakes in responding to a breach during the forensics investigation, selection of cyber insurance, communication strategies, and dealing with regulators.  Unlike other breach response panels that focus on the laws, this panel will focus on best practices and highlight the common mistakes that companies, carriers, and consultants make during the breach response process.

This presentation will focus on all aspects of recent data privacy claims and litigation trends.  While class action lawsuits garner most of the media attention and will be covered in depth here, discussion will also include governmental regulatory actions, single plaintiff litigation, Payment Card Industry enforcement, first party claim issues, and more.

SESSION 6 - Cyber Claims Crystal Ball

With the rapid development of the cyber market in the past decade, the world of cyber claims can be a volatile and fast changing place.  This presentation will focus on how the changing landscape in this sector will impact the forms and scope of coverage that are currently being (or soon will be) offered, complete with an overview of recent trends and developments relating to first- and third-party claims.  Discussion will include a comprehensive review of national/international legislative and regulatory enforcement patterns, as well as how these trends can help predict what the next one, three, five years and beyond will look like.
