Educational Topic: The unintended – or court ordered -- disclosure of privileged materials can be a nightmare for any professional handling an insurance-related claim.  Understanding the key issues, and the use of best practices, can minimize the risks of having to disclose communications intended to be privileged or confidential.  Risks arise whenever attorneys are involved in issues which courts may find to be part of the ordinary business of insurance, as opposed to bona fide legal issues. Or in cases which involve bad faith allegations.  Or when substantial e-discovery is required of insurer or policyholder communications.  This seminar will address key legal decisions, discovery rules, and ethics rules in order to provide attendees with increased understanding and increased chances of preserving attorney-client privilege and work product protection for their communications.
