Description

This course will address the most common issues disputed between primary and excess insurers, including coverage issues, settlement demands, and follow-form liability. There are separate sections that discuss the reciprocal responsibilities. With regard to primary insurers, to what extent do they have a direct duty to an excess insurer, and to what extent does the doctrine of equitable subrogation govern their rights? With regard to excess insurers, there are special issues that coverage attorneys should look for, including settlement duties and questions of exhaustion.
