Biography

Tom Tobin is a seasoned trial lawyer who focuses on complex commercial and product liability defense matters. During his career of more than 30 years at the firm, Tom has developed extensive experience representing manufacturers, including clients in the railroad, maritime and aviation industries. He is a member of Wilson Elser’s Executive Committee, co-chair of its Product Liability practice, and chair of its Railroad and e-Discovery practices.Tom’s legal practice is enhanced by the technical insight and perspective he gained through his prior work as a mechanical engineer and patent attorney at Union Carbide Corporation. Tom’s appreciation for the balanced decision-making process that engineers employ when designing and developing products and processes enables him to effectively defend clients’ design strategies and refute alternate designs presented by opposing counsel.Tom has tried or been involved in lawsuits filed in more than a dozen states and has defended clients in nearly every state. He coordinates clients’ defenses of generic claims and “pattern litigation” around the country. He also consults with international manufacturers and distributors on product safety and the minimization of product liability exposure. As part of his work for transportation industry clients, Tom assists with National Transportation Safety Board (NTSB) investigations arising from train, plane and bus accidents.Early in his career, Tom was the founding partner of a firm office in Tokyo. At that time, he was registered with the Japanese Ministry of Justice as the 25th Gaikokuho Jimu Bengoshi (foreign law solicitor). He has lectured extensively on product liability prevention and commercial litigation in the United States, Canada, United Kingdom, Japan, Korea, the People’s Republic of China and Taiwan. Tom also speaks frequently in the United States and abroad on the preservation, review and production of electronically stored information as well as on topics of interest to the railroad industry.
