Biography

Gail Gottehrer focuses her practice on employment litigation including class action defense. She represents employers on labor-related issues, ranging from responding to union organizing campaigns to negotiating union contracts. Gail also advises multistate employers on compliance with federal, state, and local laws prohibiting discrimination, retaliation, workplace bullying, and compliance with Department of Labor and EEOC regulations. She investigates complaints of alleged sexual harassment and violation of other laws and defends employers in proceedings before the EEOC and other agencies. Gail also has experience creating and monitoring social media policies and personal device policies, and provides training for managers and employees on various employment laws including, whistleblowing and cybersecurity practices. In addition, she also counsels clients on eDiscovery practices including litigation holds, data preservation, avoiding spoliation, retention policies and practices, and defensible disposition of ESI. 

Gail is an active member of the Sedona Conference Working Group on eDiscovery Cooperation and Training (WG-1), and is a frequent speaker on topics relating to litigation and technology, including litigation strategy and management, electronic discovery, information governance, telematics, wearable technology, autonomous vehicles, biometrics, artificial intelligence and robotics, and workplace privacy and ethics.
