Session 2 - Session 2: Track 2 - Defending Premises Owners in Slip and Fall Claims - Florida’s Recent “Transitory Foreign Substance” Statute Section 768.0755: What are the Practical Implications?
According to research cited in support of Florida’s recently enacted §768.0755, approximately 8,000,000 people per year claim injuries as a result of slip and fall incidents on business premises. The National Floor Safety Institute has reported that the annual cost of these accidents is $100,000,000,000. The causes of these "transitory foreign substance" incidents include foreign substances, flooring, footwear and fraud. The session will focus on the legal framework and practical implications of the recent amendment and how it affects the defense of the "transitory foreign substance" slip and fall lawsuit in Florida.

The manner in which a company responds to a catastrophic event can determine the company’s ability to effectively settle or defend the resulting claim. This seminar will inform the attendee of the best practices to use when a catastrophic event occurs, including how to undertake the initial investigation, strategies for working with the police, procedures to use when interviewing and obtaining statements from the witnesses, when and how to enlist the help of experts, and issues that should be considered regarding the Attorney-Client Privilege and/or the Work Product Doctrine during the response process.
