MEDIATION – PREPARATION, STRATEGY & ETHICAL CONSIDERATIONS
This event will focus upon issues that often arise leading up to, and during case mediations.  Topics will include (1) priming opposing counsel for the mediation process, (2) ethical obligations for attorneys, and the line between ethical and unethical conduct; (3) preparation and participation of clients and claims representatives, (4) effective mediation strategies and considerations, including but not limited to when to mediate, how to value a case, apologies, brackets, and Award Modification agreements.
