The presentation will focus on how to frame risk response during the mediation process.  It will set forth a vocabulary of terms to understand litigation risk and summarize the known psychological impediments to risk response.  Then, it will address how this psychology plays out in litigation to create divergent views, bluffing and delays toward a resolution.  Finally, it will explore an expected value mathematical model to more objectively quantify a case’s value, discuss factors to estimate the psychological opposition underlying what you will have to pay to settle a case, and consider market psychology and poker strategy to determine a plan on how to resolve the case favorably.
