The Panel Members will discuss common tactics used by plaintiff attorneys to set up insurance companies for bad faith. The Panel will also discuss hard-to-identify set-up tactics so that the audience can look for them after certain red flags have been identified in plaintiff counsel’s conduct. All levels will benefit from this Panel discussion. The presentation will be divided into 3 categories. First, common fact patterns and bad faith set-ups are identified. Strategies for dealing with each fact patter will be discussed. Second, relevant court cases will be discussed and identified. The participants will be given extensive legal briefing as seminar materials. Third, the emerging bad faith set-up defense will be discussed. A few courts have suggested the use of bad faith set-up affirmative defense.

Session 4 - The True Value Of Medical Services Versus The Collateral Source Rule: Strategies For Change
The last decade plus has seen an unprecedented escalation of the amount billed for medical services, well beyond any reasonable expectation of payment. It is not uncommon to see a private hospital submit a $130,000 bill for a surgical procedure and hospitalization, yet ultimately accept less than $30,000 as full payment. The disparity has now reached such proportions that Courts in a handful of States have held that the only relevant evidence of the reasonable value of medical services is the amount actually accepted by the medical provider as full payment. This presentation will provide a survey of this developing area of law and the judicial rationale underlying this seminal change. It will also explore strategies for continuing to try to effect favorable appellate level change and practical strategies for dealing with overstated medical bills regardless of jurisdiction.
Session 5 - Public Video Surveillance: Was Elvis Filmed Leaving The Building?

The session will cover the decision to set up surveillance cameras at premises (what business should have them and where should they be placed), preservation of video after an event has occurred (establishing protocols and enforcing compliance), what impact the video has on evaluating the liability and damages of the case; strategic use of the video in discovery (including timing of disclosure and use in preparing witnesses), and optimizing the video for use at trial (enhancement, stills).
