The intense media coverage and tort environment has a direct impact on investigating and handling claims and litigation and directly impacts health care providers' premiums and the ability to procure liability coverage.

The use of telehealth/telemedicine has risen dramatically over the last years allowing faster and more readily available access to healthcare professionals for their patients. It has allowed healthcare groups to see more patients by adding efficiencies and has allowed many people to see a physician to quickly ask about what they perceive as a “small” problem instead of ignoring that problem or delaying seeing a doctor about it. Telehealth has also allowed those in remote areas to “see” a doctor for the first time in years. But with the increase in telehealth visits, the risk of medical mistakes has also brought on new risks. This panel will discuss those risks, caselaw regarding the litigation of telehealth claims in the past and in a post-Covid world, and strategies in defending these claims.
