These days, if a public employee’s conduct was not recorded by his or her body camera, it was probably recorded by some amateur videographers with a smartphone. This webinar will focus on best practices for proactively using video evidence to defend public employees before and through litigation. Specifically, we will discuss how video evidence of public employees’ conduct is increasingly having an impact on litigation. We will also discus how such evidence can be used efficiently resolve claims pre-suit. Next, we will discuss how to evaluate video evidence to determine how it can be leveraged to efficiently resolve a suit once in litigation, including when and how to present such evidence in a dispositive motion. Finally, we will discuss research analyzing how lay people are inclined to view video evidence of public employees’ conduct.
